Do you need a DA or a CDC to demolish in Annandale?
For most Annandale properties, demolition is assessed by Inner West Council, and the work follows one of three pathways.
Some minor work is exempt development, needing no application at all, provided it meets every condition in the State planning rules. Many straightforward house demolitions can proceed as a Complying Development Certificate, or CDC: a faster, code-based approval a private certifier or the Council can issue when the job satisfies the NSW Demolition Code. Anything that does not qualify needs a full Development Application, or DA, which Inner West Council assesses against the Inner West Local Environmental Plan 2022 and the local Development Control Plan.
The catch in Annandale is heritage. Where a property is in a heritage conservation area or is a heritage item, the CDC shortcut is usually closed and the job becomes a DA. So settle the pathway before you lock in a scope.
Heritage conservation areas, and how to check whether your Annandale property is in one
Annandale holds some of the inner west’s most intact nineteenth and early twentieth century streetscapes, much of it managed by Inner West Council as heritage conservation areas. Where a DA covers a heritage item, Council requires a Heritage Impact Statement with it, and may ask for one inside a conservation area too. The controls come from the Inner West Local Environmental Plan 2022 and the former Leichhardt Development Control Plan 2013, still in force here. Getting it right matters: illegally demolishing a heritage building can expose an owner or developer to significant council penalties and orders to reinstate. Friable asbestos must be removed by a Class A licensed removalist, and for that work the air monitoring and clearance certificate are issued by an independent licensed asbestos assessor that we arrange and coordinate, never sign off ourselves. All of it meets SafeWork NSW and NSW EPA requirements.
