Developer contributions on an Engadine demolish-and-rebuild

Knock down and build something larger, and the Council can ask for a developer contribution: a payment toward the local infrastructure and open space new development draws on. It is set under the Environmental Planning and Assessment Act, separate from the demolition itself.

Two kinds can apply. A section 7.11 contribution (you may still see it called section 94) is tied to a Council contributions plan and the demand your project creates. A section 7.12 contribution (formerly section 94A) is a fixed percentage levy on the cost of the works. Which one, if either, depends on what you build and the plans Sutherland Shire Council has in force.

This is not a charge on every Engadine job, but it is real here. The Council’s own developer contributions register lists Engadine building approvals against section 7.12 open-space levies, and it has applied a contributions plan covering the Engadine centre precinct to town-centre redevelopment. Who decides your Engadine application, the Council or a planning panel

Not every Engadine demolition is decided the same way, and it is worth knowing who signs off yours.

At the light end, some work is exempt development and needs no approval at all, and much straightforward house demolition qualifies as complying development, approved on a fast, code-based Complying Development Certificate (CDC) that a registered certifier or the Council can issue. Work outside the code needs a full Development Application (DA) to the Council, lodged through the NSW Planning Portal.

Most DAs are then determined by Sutherland Shire Council. The exception is what makes Engadine worth checking: larger and town-centre projects can be referred to a Sydney regional planning panel, an independent body that decides in the Council’s place. A recent Engadine redevelopment that paired demolition with a residential flat building went to a panel rather than the Council alone. A single-house knockdown will not reach that threshold, but a bigger job can, changing who assesses it and how long it takes.

Asbestos, cleared before the structure comes down

Any house built before the late 1980s can contain asbestos, often in fibro sheeting, eaves, cement pipes or old floor backing. It has to come out before demolition, not during, so every job opens with a pre-demolition inspection for asbestos and other hazardous materials. Where it is found, our licensed removalists take it out first and dispose of it at a licensed facility, under SafeWork NSW and NSW EPA rules.

It comes in two forms. Non-friable is bonded into solid sheeting and stays put unless it is cut or broken. Friable is loose or crumbling, controlled far more tightly as Class A work, which we are licensed to carry out. For friable removal, the air monitoring and clearance certificate are issued by an independent licensed assessor we arrange and coordinate, never sign off ourselves. Structural demolition starts only once the site is cleared and certified, and our licensed asbestos removal covers both types.
