One LEP, three DCPs: the part that trips people up in Enmore

Here is the wrinkle that catches Enmore owners out. When the former Marrickville, Leichhardt and Ashfield councils merged into the Inner West, the council consolidated its Local Environmental Plan into a single instrument, the Inner West LEP 2022, that now covers the whole area. What it did not do is merge the Development Control Plans. There are still separate DCPs inherited from the former council areas, and Enmore sits in the former Marrickville area, so the former-Marrickville DCP is the one that governs the detail of a demolition here.

Why does that matter to you? Because the DCP is where the practical demolition controls live, the site management, waste, tree and notification requirements, and applying the wrong one wastes time. The lodgement clock, and what happens after consent

Inner West Council tightened its lodgement process, and it now runs on a clock worth knowing before you apply. When a demolition application is lodged, the council checks it against a documentation requirement at lodgement. If something is missing, you get one chance to supply it inside a short window, and if the request is not met the application can be returned rather than assessed. There is also a short period to pay the fees once invoiced. Miss either and you are back at the start.

Consent is not the finish line either. A demolition in the Inner West typically carries post-consent obligations that owners forget to budget for: an asset-protection or road-and-footpath damage bond lodged with the council before work starts, developer contributions under section 7.11 or 7.12 where they apply, and a notice to the council a couple of days before demolition commences.
