Which council approves a demolition in Dural: Hornsby Shire or The Hills Shire?

Most Sydney suburbs answer to one council. Dural answers to two. The boundary falls so that some addresses sit in Hornsby Shire and others in The Hills Shire, each a separate consent authority. Before anything is quoted or lodged, the first thing to settle is which one is yours.

You can confirm it from the property: a section 10.7 planning certificate names the council and controls for any NSW address. We check it at the site assessment, then lodge through the NSW Planning Portal to the right council.

Whichever council it is, the rule is the same. Under clause 2.7 of the relevant Local Environmental Plan, demolishing a building needs development consent unless it counts as exempt work. From there it runs as exempt development for minor work, a fast code-based Complying Development Certificate (CDC) where it strictly meets the standards, or a full Development Application (DA). That choice moves your timeline more than anything on site.

What Hornsby or The Hills Shire may ask for

The exact documents depend on your site and the pathway, but a few are worth knowing early.

Hornsby’s plan carries a clause written for this suburb: clause 6.6 of the Hornsby Local Environmental Plan 2013, “Restrictions on certain development in Dural Village”. If your block sits inside the mapped Dural Village area, that is one more control the council checks, alongside the Part 6 rural-land provisions that often apply on larger, vegetated lots. For a DA, Hornsby’s current guideline may call for a plan protecting the public and Council’s assets during the works, and a waste plan setting out reuse, recycling and disposal.

The Hills Shire assesses its side under its own planning instruments and asks for a Waste Management Plan with any demolition. Its form wants your demolition contractor’s licence number, which a licensed contractor supplies as a matter of course. The Hills also runs a formal request for work outside standard consent hours, granted only in exceptional circumstances, useful if your job needs after-hours or emergency work.

Both are LGA-wide, read against your actual address.

Trees, vegetation and the complying-development trap

Here is the trap on a leafy Dural block. Even where a knockdown would otherwise qualify for the fast CDC route, Hornsby’s rules withdraw it if the work involves removing or pruning a tree or other vegetation that needs a permit or consent (Schedule 3 of the Hornsby Local Environmental Plan 2013). On a large, established lot, clearing around the building often means touching protected vegetation, which can push the whole job onto a DA. Check your trees before you count on the quick route; we flag it early on a vegetated site.

Out in Sydney’s north-west, Dural is large, often semi-rural blocks, not terraces and semis, and the work reflects that. The job we are asked for most is a full house demolition for a rebuild, and on a big block it rarely stops there. On a Dural property we regularly take on:

Asbestos, cleared before the structure comes down

Older buildings can hold asbestos, so a pre-demolition inspection comes before any structural work. If it is found, it is removed under licence and the site cleared first, never alongside the demolition. We are licensed for both types. Non-friable asbestos is bonded into solid material such as cement sheeting, removed under a Class B licence. Friable asbestos is the loose, crumbling kind, held to stricter rules, and only a Class A licence holder may remove it. For friable work an independent licensed assessor we arrange carries out the air monitoring and clearance certificate, not us, so the clearance is genuinely at arm’s length. It all meets SafeWork NSW and NSW EPA requirements.

Not if the application goes to the right authority first time. The delay owners hit is lodging with the wrong council, or assuming the fast CDC applies when a tree or heritage control rules it out. We confirm the authority and pathway up front.

Can I demolish my own house in Dural?

It still needs approval, and much demolition work must be done by a licensed demolisher under SafeWork NSW rules, with any asbestos removed by a licensed removalist.
